1. Acceptance of Terms

By making a booking with Berowra Waters Holidays (“we”, “our”, “us”), you agree to be bound by these Terms & Conditions.

These Terms apply to all bookings made directly via our website, email, phone, or third-party booking platforms.

2. Bookings & Payments

2.1 Booking Confirmation

A booking is confirmed once:

• Required deposit or full payment is received; and
• You receive written confirmation from us.

2.2 Payment Terms

• A deposit may be required at time of booking.
• Full payment must be made prior to arrival.
• Last-minute bookings may require full payment at time of booking.
• We reserve the right to cancel bookings where payment is not received by the due date.

3. Security Bond

A security bond may be required prior to check-in. The bond may be used to cover property damage, excess cleaning, lost keys, or breaches of house rules.

The bond will be refunded within 3–5 working days after departure, subject to inspection.

4. Cancellations & Refunds

4.1 Guest Cancellations

4.2 Host Cancellation

If we are unable to provide the booked accommodation due to unforeseen circumstances, we will offer alternative accommodation (if available) or provide a full refund.

Liability is limited to the amount paid for the booking.

5. Check-In & Check-Out

• Check-in time: 2pm onwards.
• Check-out time: 10:30am.
• Early check-in or late check-out may be available by prior arrangement and may incur a fee.
• Failure to vacate on time may result in additional charges.

6. Guest Responsibilities

• Treat the property with care and respect.
• Leave the property in reasonable condition.
• Follow all house rules provided.
• Ensure the number of guests does not exceed the booking confirmation.
• Supervise children at all times.
• Comply with local noise regulations.

7. Noise & Conduct

Berowra Waters Holidays properties are located in a peaceful riverside community.

• No parties or events unless approved in writing.
• Quiet hours must be respected.
• Excessive noise may result in eviction without refund.
• We comply with NSW Short-Term Rental Accommodation Code of Conduct.

8. Pets

• Guests must seek approval to bring pets along prior to arrival.
• Guests must clean up after their pets on departure or a cleaning fee may apply.
• Pets are not allowed up on the furniture.

9. Damage & Cleaning

• Guests are responsible for any damage caused during their stay.
• Accidental damage must be reported immediately.
• Additional cleaning fees apply if the property is left excessively dirty.

10. Access & River Conditions

Most properties are accessible only by boat. Guests acknowledge that river and weather conditions may affect access.

• Berowra Waters Holidays is not responsible for disruptions caused by river or weather.
• Guests use jetties, pontoons, boats, kayaks, and water equipment at their own risk.

11. Safety & Risk

Waterfront properties present inherent risks, including slippery surfaces and water access.

• Guests are responsible for their own safety and that of their invitees.
• We are not liable for injury, loss, or damage except where required by law.

12. Limitation of Liability

• We are not liable for loss, theft, or damage to personal belongings.
• We are not liable for interruptions beyond our control.
• Liability is limited to the amount paid for the booking.
• Nothing excludes rights under Australian Consumer Law.

13. Use of Website

• Do not misuse booking systems or upload malicious content.
• All website content remains the property of Berowra Waters Holidays.

14. Privacy

Your personal information is handled in accordance with our Privacy Policy.

15. Force Majeure

We are not liable for failure to perform due to events beyond our control, such as natural disasters, floods, or bushfires.

16. Governing Law

These Terms & Conditions are governed by the laws of New South Wales, Australia.

17. Amendments

We reserve the right to update these Terms at any time via our website.
